Liability for Content

As a service provider, we are responsible for our own content on these pages in accordance with general laws. However, we are not obligated to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity.

1. Scope

These Terms and Conditions apply to all orders placed through our online shop vukdizajn.art between the customer and INDI vl. Monika Kunstek, registered in Croatia.

These terms are governed by the laws of the Republic of Croatia, including the Consumer Protection Act (Zakon o zastiti potrosaca) and the Electronic Commerce Act (Zakon o elektronickoj trgovini).

2. Contract Formation

The purchase contract is concluded with INDI vl. Monika Kunstek.

The presentation of products in the online shop does not constitute a legally binding offer. By clicking the "Place Order" button, you submit a binding order. Confirmation of receipt of the order is sent immediately after submission.

3. Products

We offer two types of products:

• Premium Prints: High-quality canvas prints produced on demand by our printing partner Prodigi.
• Handmade Originals: Custom hand-painted artwork created upon request. These are unique pieces made individually for each customer.

4. Delivery

Delivery is carried out by our printing partner Prodigi directly to the delivery address you provide.

Estimated Delivery Times:

• Croatia & EU: 5-14 business days
• International: 10-21 business days

Products are manufactured after order placement (print-on-demand). Delivery times may vary depending on destination and product type.

5. Prices and Shipping

All prices are displayed in Euros (EUR) and include VAT where applicable. Shipping costs are shown separately during checkout and are to be paid by the customer.

6. Payment

Payment is processed via credit card (Visa, Mastercard) or PayPal through our payment provider Stripe. Payment is charged upon order completion.

7. Warranty

In accordance with Croatian Consumer Protection Act, consumers are entitled to a 2-year warranty for defects that existed at the time of delivery. Due to the nature of printed products, minor variations in color and size may occur and do not constitute defects.

8. Handmade Artwork

For custom handmade original artwork, special conditions apply. These are created individually upon request. Prices are calculated based on size and complexity. As these are custom-made items, the right of withdrawal does not apply.

9. Applicable Law

These terms are governed by the laws of the Republic of Croatia. For consumers within the EU, mandatory consumer protection provisions of your country of residence also apply.

Order Data

When placing orders, we collect: name, delivery address, email address, and phone number (optional). This data is used for order processing and delivery.

Payment Data

Payments are processed through Stripe. We do not store credit card data. Stripe processes your payment data in accordance with their privacy policy.

Server Log Files

Our hosting provider automatically collects information in server log files: browser type, operating system, referrer URL, IP address, and time of server request.

Prodigi: Our printing partner receives the data necessary for production and delivery (name, address).

Stripe: Payment processing in accordance with their privacy policy.

IONOS: Hosting provider for this website.

Under GDPR, you have the right to:

• Access your personal data
• Rectification of inaccurate data
• Erasure of your data ("right to be forgotten")
• Restriction of processing
• Data portability

6. Data Retention

We retain your personal data only for as long as necessary for the purposes for which it was collected, or as required by law. Order data is retained for 10 years in accordance with Croatian accounting regulations.

We only use essential cookies that are strictly necessary for the operation of our online shop:

• Session Cookie (connect.sid): This cookie is required to maintain your shopping cart while browsing the shop. It is automatically deleted when you close your browser or after a short period of inactivity.

Stripe: When you proceed to payment, Stripe (our payment processor) may set cookies necessary for secure payment processing. These cookies are governed by Stripe's own cookie policy.

Legal Basis

Essential cookies are used based on our legitimate interest (Art. 6(1)(f) GDPR) to provide a functional online shop. No consent is required for strictly necessary cookies under the ePrivacy Directive, but we inform you about their use through our cookie banner.

Right of Withdrawal (EU Consumers)

In accordance with EU Consumer Rights Directive and Croatian Consumer Protection Act, you have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period expires 14 days from the day on which you, or a third party indicated by you, acquires physical possession of the goods.

Exceptions

The right of withdrawal does not apply to:

• Goods made to the consumer's specifications or clearly personalized (custom handmade artwork)
• Goods that have been unsealed and are not suitable for return due to health or hygiene reasons

How to Exercise Your Right

To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g., email).

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs if you chose a delivery method other than the least expensive standard delivery), without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw.

Damaged or Defective Items

If you receive a damaged or defective product, please contact us immediately at info@vukdizajn.art with photos of the issue. We will arrange for a replacement or refund.
